Can HaDSCO assist with my claim for medical negligence compensation?

Can HaDSCO assist with my claim for medical negligence compensation?

HaDSCO cannot assist you with any compensation claims.

If a health care provider fails to take reasonable care to avoid harming a patient, and that patient has suffered physical harm, psychological harm or financial loss as a result, then that patient may consider making a medical negligence claim against the health care provider. If a patient chooses to make a medical negligence claim and is successful, then they may be awarded compensation by the courts.

If a patient wishes to pursue a medical negligence claim, we strongly recommend that the patient obtain their own independent legal advice. This process is separate from the resolution service provided by HaDSCO and we cannot offer legal advice on any prospective claims.

If you want to obtain legal advice, you may wish to consult a lawyer who specialises in personal injury law. Legal Aid WA can assist you to find an accredited specialist. They can be contacted at legalaid.wa.gov.au or by phone on 1300 650 579.
